Trump Traps: What’s at stake for DACA?

Deferred Action for Childhood Arrivals (DACA) has been a lifeline for hundreds of thousands of young immigrants, offering temporary protection from deportation and providing work authorization. However, this critical program has faced significant challenges, particularly under the prior Trump administration, leaving its future uncertain. What is DACA?

DACA was established in 2012 by President Obama. The program provides relief from deportation and work permits to certain undocumented individuals who were brought to the U.S. as children. To qualify for DACA, applicants must have met strict criteria, including:

  • Arriving in the U.S. before their 16th birthday.
  • Continuous residence in the U.S. since June 15, 2007.
  • Being under the age of 31 as of June 15, 2012.
  • Being in school, having graduated from high school, having obtained a GED, or being an honorably discharged veteran.
  • No significant criminal record.

Although DACA does not provide a path to citizenship, it offers a reprieve that allows recipients—often called Dreamers—to pursue education, employment, and a more stable life in the U.S.


Trump’s Attacks on DACA

The DACA program faced its most significant challenges under the Trump administration. In September 2017, then-Attorney General Jeff Sessions announced that the program would be rescinded, arguing that it was an overreach of executive power. This move threw the lives of nearly 800,000 Dreamers into uncertainty. Trump’s decision to end DACA sparked a series of legal challenges:

  • Federal courts issued injunctions, requiring the government to continue processing DACA renewals but blocking new applications.
  • In June 2020, the Supreme Court ruled that the Trump administration’s attempt to terminate DACA was “arbitrary and capricious” and violated federal law. While the ruling was a victory for Dreamers, it left the door open for his administration to try again.

Despite the Supreme Court ruling, the Trump administration continued to chip away at the program:

  • New DACA applications were halted.
  • Renewal periods were shortened from two years to one year, increasing costs and burdens on recipients.

The Current Status of DACA

Under the Biden administration, efforts have been made to stabilize and fortify DACA. President Biden issued an executive order to preserve and strengthen the program on his first day in office. Additionally, the Department of Homeland Security (DHS) issued a final rule in October 2022, which aimed to codify DACA into a more formal regulation.

However, DACA remains on shaky ground due to ongoing litigation. In July 2021, a federal judge in Texas ruled that the program was unlawful, blocking new applications. While current recipients can still renew their status, no new applicants are being accepted.

What This Means for Dreamers Today:

  • Renewals: Current DACA recipients can continue renewing their status.
  • New Applications: First-time applicants are currently unable to apply.
  • Legal Uncertainty: The program’s ultimate fate depends on future court decisions and potential legislative action.

What’s Next for DACA?

The future of DACA is deeply uncertain and depends on many factors.

  1. Legislative Action: Many advocates argue that the only permanent solution is through Congress. The proposed Dream Act has been introduced multiple times but has yet to pass. This legislation would provide a pathway to citizenship for Dreamers, offering long-term stability.
  2. Supreme Court Review: DACA will likely face scrutiny again, this time from a much more conservative and Trump-friendly Supreme Court. The program could be upheld, modified, or dismantled entirely.
  3. State-Level Protections: Some states have implemented policies to support Dreamers, such as offering in-state tuition and state-funded financial aid. These measures provide some relief but are not a substitute for federal action.
